Therapist Terms

1. About these Terms

These Terms apply to therapists and other independent providers who offer services through Servu.By applying, onboarding, listing, making offers, accepting bookings, receiving payouts or otherwise using Servu as a therapist provider, you agree to these Terms.

2. Independent provider relationship

Servu is a marketplace platform. You provide services in your own capacity as an independent provider or business.You are not an employee, agent, partner or representative of Servu merely because you use the platform. Contractor status depends on the real arrangement, not only whether you have an ABN.You are solely responsible for:a) how you provide your servicesb) your business operationsc) your tax, superannuation and insurance obligationsd) your qualifications, licensing and compliance

3. Eligibility and onboarding

To offer services through Servu, you may be required to provide:a) legal name and contact detailsb) date of birthc) profile imaged) ABN details where applicablee) qualifications or certificatesf) insurance detailsg) ID documentsh) bank payout detailsi) any other documents reasonably requested by ServuServu may approve, refuse, pause or withdraw access to the platform in its discretion where verification is incomplete, unsatisfactory, expired or inconsistent.

4. Verification

Servu may conduct verification and screening checks to support trust and safety. Verification is a platform entry requirement only. It does not replace your own legal or professional responsibilities.You must ensure all information and documents provided are true, current and complete. You must promptly update any changes, including:a) expired insuranceb) changed ABN or business detailsc) lapsed qualificationsd) changed contact or payout details

5. Your provider obligations

You agree to:a) provide services lawfully, safely and professionallyb) only offer services you are qualified, competent and insured to performc) maintain required qualifications, registrations, permits and insuranced) attend bookings on time and communicate promptlye) follow reasonable hygiene, safety and infection-control practicesf) behave respectfully and professionally toward clients and venue staffg) keep client information confidentialh) use Servu only for genuine bookings and related communications

6. Safety and work conditions

You are responsible for assessing whether a booking can be completed safely and appropriately.You may refuse or stop a service where there is a legitimate safety, hygiene, harassment, intoxication, violence, access or other serious concern.Under Australian WHS guidance, duties can be shared and are not transferable. Providers remain responsible for meeting applicable WHS obligations in the way they conduct their work.You must report serious safety incidents, threats, harassment, suspected unlawful conduct or platform misuse to Servu as soon as possible.

7. Booking process and address disclosure

You may receive booking requests, request details, consultation notes, suburb-level location information and other relevant booking information.Exact client addresses are only disclosed after:a) a booking is confirmed, andb) payment is confirmed through the platform.You must only use address and contact information for the relevant booking and must not retain, misuse, disclose or contact users outside the legitimate scope of that booking, except as permitted by law or by Servu.

8. Pricing, fees and payouts

You authorise Servu and its payment provider to:a) collect payments from clientsb) deduct platform fees and payment processing amountsd) hold, delay or reverse payouts where reasonably necessary for disputes, fraud, chargebacks, compliance or policy enforcemente) pay out your net earnings to your nominated payout accountYou are responsible for understanding the fee structure and any taxes that apply to your earnings

9. Taxes and ABN

You are responsible for your own tax affairs, GST obligations, invoices, superannuation and business registrations.Where relevant, you must provide a valid ABN and keep it current. The ABR notes that not everyone is entitled to an ABN, and misuse can carry consequences.

10. Off-platform dealing

You must not use Servu to source clients and then move the booking or payment off-platform to avoid fees, checks, records or platform protections.

11. Cancellations, no-shows and conduct

You must comply with SERVU’s booking rules and policies, including:a) cancellation rulesb) punctuality expectationsc) no-show proceduresd) dispute and evidence processese) support and incident reporting requirementsRepeated lateness, provider no-shows, poor communication, unsafe conduct, misleading profiles or policy breaches may lead to reduced visibility, payout holds, account restrictions or removal from the platform.

12. Client disputes and refunds

Where a client reports a problem, Servu may investigate and request information from you, including messages, time records, photos or explanations.Servu may issue or facilitate full or partial refunds, payout adjustments, credits, warnings or other reasonable platform actions where appropriate, subject to applicable law and payment-provider processes. Consumer guarantee rights may still apply under Australian Consumer Law.

13. Insurance and risk

You are responsible for maintaining any insurance reasonably required for the services you offer, which may include public liability, professional indemnity, treatment liability, equipment cover, or other relevant cover depending on your services.Servu may request proof of insurance at any time.

14. Suspension or termination

Servu may restrict, suspend or terminate your account where we reasonably believe there is:a) false, misleading or incomplete onboarding informationb) expired or missing verification documentsc) unsafe, inappropriate or unlawful conductd) repeated cancellations or no-showse) serious customer complaintsf) privacy breachesg) off-platform solicitationh) reputational, legal or payment risk to SERVU or users

15. Liability

To the maximum extent permitted by law, you are responsible for the services you provide and for losses, claims, injury, damage or disputes arising from your acts or omissions.Servu is not responsible for your business decisions, tax obligations, professional conduct, insurance coverage or service outcomes.Nothing in these Terms excludes rights that cannot lawfully be excluded.

16. Privacy and confidentiality

You must handle personal information obtained through Servu carefully and only for the relevant booking. You must not use, disclose, store or share user information except as reasonably necessary to complete the booking or as required by law.

17. Changes to these Terms

We may update these Terms from time to time. Updated terms apply from the stated effective date.

18. Governing law

These Terms are governed by the laws of [jurisdiction/state], Australia.
